Yesterday, the Supreme Court confirmed that a final decision in one case, if being tried with other consolidated cases, is an immediately appealable order. This is somewhat of a victory for plaintiffs in complex antitrust cases, particularly class cases, which frequently include several consolidated cases. Plaintiffs and defendants alike will no longer have to wait until all consolidated cases are resolved, which can take anywhere from several months to several years in some cases, to appeal an adverse final decision.
